John C. Kurzawa, Sr. and his wife, Frances Kurzawa, individually and on behalf of their son John Casmere Kurzawa, Jr. (Cass) appeal the judgment of the district court that dismissed their § 1983 lawsuit and pendent state claims against the defendants. The district court, 545 F. Supp. 1254, dismissed the Kurzawas lawsuit pursuant to the defendants motion. It was determined that the statute of limitations and the defendants right to qualified immunity abrogated the Kurzawas claims. For the reasons set forth below, we affirm the decision of the district court.
